Terms of Service

These Terms of Service ("Terms") govern your use of lucAI and the luca.ecosystem platform (collectively, the "Service"), operated by Luca ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

• You must be at least 16 years of age to use the Service
• If you are between 16 and the age of legal majority in your jurisdiction, you must have parental or guardian consent
• We do not knowingly allow users under 16 to create accounts
• By using the Service, you represent and warrant that you meet these eligibility requirements

2. Account Registration

• You must provide a valid email address and a password of at least 8 characters
• You may optionally provide a display name for marketplace attribution
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

3. AI-Generated Content

lucAI is powered by artificial intelligence. You acknowledge and agree that:

• AI outputs may be inaccurate, incomplete, biased, or outdated — they are provided "as is" without warranty of accuracy
• AI-generated content does not constitute professional advice (medical, legal, financial, engineering, or otherwise)
• You should independently verify any information obtained through lucAI before relying on it
• The EU AI Act classifies lucAI as a general-purpose AI system — you are interacting with AI, not a human
• We may use your interactions to improve the Service (see our Privacy Policy)

4. Acceptable Use

You agree not to use the Service to:

• Generate, store, or transmit illegal, harmful, threatening, harassing, defamatory, or otherwise objectionable content
• Violate any applicable law, regulation, or third-party rights
• Attempt to reverse-engineer, decompile, or extract the underlying AI models or training data
• Use the Service to build competing products or services
• Circumvent rate limits, authentication mechanisms, or other security measures
• Send automated or bulk requests without our written permission
• Impersonate any person or entity
• Upload malicious code, viruses, or content designed to disrupt the Service
• Use the Service to process sensitive personal data of third parties without their consent
• Replicate, clone, or fork the luca.ecosystem architecture or branding

5. User Content

• You retain ownership of all content you submit to lucAI (prompts, knowledge base documents, etc.)
• You grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service
• We do not use your content for model training — our AI provider (Groq) processes your messages in real-time only
• You are solely responsible for the legality and appropriateness of content you submit

6. lucTOOLS Marketplace

The lucTOOLS Market allows developers to publish and share AI-powered prompt tools. By publishing tools on the marketplace:

• You represent that you have the right to publish the tool and its content
• Your tool will be attributed with your display name (or "Anonymous" if not set)
• We reserve the right to review, reject, or remove tools that violate these Terms
• Published tools are publicly visible and can be used by any registered user
• We are not responsible for the accuracy, quality, or safety of third-party tools
• Tool usage counts and metadata may be displayed publicly

7. Intellectual Property

• The Service, including its code, design, branding, and AI integration, is owned by luca.ecosystem
• lucUI is an open-source CSS framework — see its respective license for terms
• The luca.ecosystem name, logos, and branding are our intellectual property
• You may not use our branding, trademarks, or logos without written permission
• Developer-published tools remain the intellectual property of their respective creators

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind
• We do not warrant that the Service will be uninterrupted, error-free, or secure
• We do not warrant the accuracy, reliability, or completeness of any AI-generated content
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim (or EUR 0 if you use the free tier)
• We shall not be liable for any indirect, incidental, consequential, or punitive damages

Note for EU consumers: Nothing in these Terms excludes or limits liability that cannot be excluded under applicable EU consumer protection law, including the EU Consumer Rights Directive 2011/83/EU.

9. Indemnification

You agree to indemnify and hold harmless luca.ecosystem, its operators, and representatives from any claims, losses, or damages arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

• You may delete your account at any time by contacting us via the contact form
• We may suspend or terminate your account at our discretion, with or without cause, with reasonable notice
• We may suspend or terminate accounts immediately for violations of these Terms
• Upon termination, your data will be processed in accordance with our Privacy Policy

11. Dispute Resolution

• These Terms are governed by the laws of Romania and applicable EU regulations
• Any disputes shall first be resolved amicably through good-faith negotiation
• If negotiation fails, disputes shall be submitted to the competent courts of Bucharest, Romania
• If you are an EU consumer, you may also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

12. Changes to These Terms

• We reserve the right to modify these Terms at any time
• Material changes will be communicated via the Service or by email at least 14 days before taking effect
• Continued use of the Service after changes take effect constitutes acceptance
• If you disagree with modified Terms, you must stop using the Service and request account deletion

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
